Welcome to Loqus ("Service"), provided by 3Jane Technologies LTD ("3Jane," "we," "us," or "our"), registered at Aiantos 22 Agioi Omologités, 1082 Lefkosia, Cyprus. These Terms of Service ("Terms") govern your access to and use of the Loqus macOS application, including any associated services, features, content, and functionality. The Service is currently provided as a public beta version, offering users early access to our innovative artificial intelligence-powered assistant platform. By downloading, installing, or using the Loqus macOS application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. You must be at least 18 years old to use the Service. We strongly encourage you to read these Terms carefully, as they contain important information about your rights, obligations, and the experimental nature of our beta software.
Loqus is currently provided as a public beta service ("Beta"), which means the software is in a testing and evaluation phase. This beta status carries significant implications for users, and it is crucial to understand the experimental nature of the Service. The Beta represents a pre-release version of our software that is still under development and testing, and as such, may contain bugs, errors, or other issues that could affect its functionality, reliability, or performance. By participating in our Beta program, you acknowledge and accept that the Service may not operate as intended and that you are using it with the understanding of its developmental status. We actively encourage feedback from our beta users to help improve the Service, but we cannot guarantee that any particular issues will be resolved or that suggested features will be implemented.
The Service operates exclusively as a macOS application, leveraging cutting-edge artificial intelligence technologies to provide an advanced digital assistant experience. Our platform integrates with various third-party artificial intelligence models and services, including but not limited to OpenAI's ChatGPT, Anthropic's Claude, DeepSeek, Meta AI's Llama, and other AI models. These integrations are fundamental to our Service's functionality, but it is important to understand that we act solely as an intermediary, facilitating access to these third-party services. We do not create, train, or modify the underlying AI models; instead, we provide an interface to access their existing capabilities through our application. The features, functionality, and availability of these third-party services may impact your experience with Loqus, and we cannot guarantee their continuous availability or performance.
During the Beta period, the Service is provided on an "as-is" and "as-available" basis, subject to modification, suspension, or discontinuation at any time without prior notice. We maintain the right to implement significant changes to the Service, including but not limited to: adding or removing features, modifying the user interface, adjusting performance parameters, updating security protocols, and altering the way the Service interacts with third-party AI services. These changes may be made at our sole discretion and may occur frequently during the Beta period as we optimize and refine the Service. Additionally, we reserve the right to introduce paid subscriptions or premium features at any time, with reasonable notice to users. While the Service is currently offered free of charge during the Beta period, this should not be construed as a guarantee of perpetual free access.
To access the Service, users must create an account using a valid email address. The account creation process is designed to collect essential information needed to provide and improve the Beta service. During registration, you agree to provide accurate, current, and complete information about yourself as prompted by the registration process. This information helps us understand our user base, maintain security, and optimize the Beta program. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We implement various security measures to protect user accounts, but the experimental nature of the Beta means that security features may be updated or modified as we identify potential improvements or vulnerabilities.
As a Beta program participant, you play a crucial role in the development and improvement of the Service. Your usage patterns, feedback, and reported issues contribute valuable data that helps us refine and enhance the platform. Beta participants may be invited to participate in surveys, provide feedback, or report bugs and issues they encounter while using the Service. While such participation is voluntary, it is encouraged and helps us deliver a better product. We may also provide Beta participants with special access to new features or capabilities before they are made available to the general public, though such access is not guaranteed and may be revoked at any time.
During the Beta period, we maintain an extensive data collection protocol to ensure the continuous improvement and optimization of our Service. The data we collect encompasses a wide range of information, including but not limited to: account information (such as email addresses and optional profile details), communication data (including all interactions with AI models, chat messages, and queries), technical data (such as device specifications, operating system version, and performance metrics), usage patterns (including feature utilization, session duration, and interaction frequency), error logs (including crash reports, bug occurrences, and system failures), and user feedback (both explicit and implicit). This comprehensive data collection is essential for understanding how users interact with the Beta, identifying areas for improvement, and ensuring the stability and reliability of the Service. It's important to note that while we collect this data, we implement strict security measures to protect user privacy and maintain data confidentiality throughout the collection and analysis process.
The data collected during the Beta period serves multiple crucial purposes in our development and optimization efforts. We utilize this information to: analyze user behavior and interaction patterns to improve the user experience; identify and resolve technical issues and bugs; optimize performance and resource utilization; develop and refine new features based on user needs and preferences; generate anonymous statistical analyses for internal development purposes; and enhance the overall stability and reliability of the Service. While we collect and process this data extensively, we maintain a strict policy of not using user data for AI model training purposes. Our role is limited to facilitating access to third-party AI services, and we do not contribute to or modify the underlying AI models used by these services. All data processing activities are conducted in compliance with applicable data protection regulations, with a focus on maintaining user privacy and data security.
Our Service integrates with various third-party AI models and services, each with its own data handling practices and privacy policies. When you interact with these services through our platform, your queries and interactions are processed by the respective third-party providers. It's important to understand that while we facilitate these interactions, we do not control how these third-party services process or utilize the data they receive. We maintain transparent communication about which third-party services are being used and provide links to their respective privacy policies where applicable. Our role is limited to transmitting your queries to these services and delivering their responses back to you through our interface. We do not modify, enhance, or train these AI models with your data, and we implement appropriate security measures to protect data during transmission to and from these third-party services.
The Beta nature of our Service comes with inherent limitations and potential risks that users must acknowledge and accept. The Service may exhibit unexpected behavior, including but not limited to: system crashes or freezes, data processing errors, inconsistent performance, temporary service interruptions, and varying response times from AI models. These issues are an expected part of the Beta testing phase and may occur without warning. While we carefully select our third-party service providers and maintain professional relationships with them, we cannot guarantee their services or be held responsible for any issues arising from their use. Users acknowledge that these third-party services operate independently of our control and may be subject to their own terms of service, privacy policies, and operational constraints.
During the Beta period and beyond, all intellectual property rights related to the Loqus platform, including but not limited to software, design elements, logos, trademarks, and proprietary information, remain the exclusive property of 3Jane Technologies LTD. The Beta status of the Service does not diminish or alter these intellectual property rights in any way. Users are granted a limited, non-exclusive, non-transferable, and revocable license to use the Beta Service for its intended purpose, subject to these Terms. This license explicitly prohibits any attempt to reverse engineer, decompile, or extract the source code of the Service, as well as any unauthorized modification, distribution, or creation of derivative works based on the Service. We maintain robust protection of our intellectual property rights while simultaneously respecting the intellectual property rights of our users and third-party service providers.
While using the Beta Service, users may generate, input, or transmit various forms of content through their interactions with the platform and its integrated AI services. Users retain their rights to any original content they create or provide through the Service. However, by using the Service, users grant 3Jane Technologies LTD a worldwide, non-exclusive, royalty-free license to use, store, and process this content for the purposes of providing, improving, and developing the Service. This license includes the right to analyze usage patterns, collect feedback, and generate anonymous statistical data. It's important to note that while users retain ownership of their content, the experimental nature of the Beta means that we cannot guarantee the preservation or integrity of user-generated content, and users should maintain their own backups of important information.
While the Service is currently provided free of charge during the Beta period, users explicitly acknowledge and agree that 3Jane Technologies LTD reserves the absolute right to implement monetization strategies, including but not limited to subscription plans, premium features, usage-based pricing, or any other revenue models, at any time and at our sole discretion. The transition from a free Beta service to a paid commercial service may occur with reasonable notice to users, though the definition of "reasonable notice" shall be determined by us. During this transition period, we may implement various pricing tiers, feature restrictions, or usage limitations that differ from those available during the Beta period. Beta users' continued use of the Service following the introduction of paid features or subscription requirements will constitute acceptance of such changes. While we may choose to offer special considerations or promotional rates to early Beta users, we are under no obligation to do so, and any such offers will be made at our discretion.
The Beta period serves as a crucial phase for testing and refining various features and capabilities of the Service. Users acknowledge that the current feature set, functionality, and service characteristics may undergo substantial changes as we progress toward a commercial release. The experimental nature of the Beta does not exempt users from their obligations to comply with these legal requirements, and users remain solely responsible for ensuring their use of the Service adheres to all applicable laws in their jurisdiction.
These Terms and any disputes arising from or relating to the Beta Service shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions. Any legal proceedings related to these Terms or the Service shall be brought exclusively in the courts of Cyprus, and users hereby consent to the personal jurisdiction of such courts. In the event of any dispute, users agree to first attempt to resolve the matter informally by contacting us directly. If informal resolution is not possible, any formal legal proceedings shall be conducted solely on an individual basis. Users explicitly waive any right to participate in class actions, class arbitrations, or representative actions related to the Beta Service.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein, and the unenforceable or invalid provision shall be replaced with an enforceable and valid provision that best reflects the intent of the original provision. Certain provisions of these Terms, by their nature, shall survive any termination or expiration of your participation in the Beta program, including but not limited to provisions relating to intellectual property rights, liability limitations, indemnification obligations, and dispute resolution procedures.
